The Board released its judgment in Public Services Association of Trinidad and Tobago v Trinidad and Tobago Civil Aviation Authority [2025] UKPC 40 last week on 11 September, holding that the PSA was deemed to be the recognised majority union for a bargaining unit of certain employees at the CAA, but that the CAA had not committed an offence by failing to collectively bargain with the PSA because, at the relevant time, the PSA was not formally registered as the union, owing to the dispute over its status.

Trinidad and Tobago cases continue this week, with judgments scheduled to be handed down on Tuesday in:

  • Attorney General of Trinidad and Tobago v CL Financial Ltd (in Liquidation), concerning whether the Court of Appeal erred when it determined an appeal against the liquidators’ fee approval without considering the detailed reasons published by the judge after the appeal was launched. The judgment may also provide some guidance on assessing a liquidator’s fees.
  • University of the West Indies v Occupational Health and Safety Authority and Agency, a dispute about which limitation period applies to a prosecution of health and safety offences before the Industrial Court.
